Acceptance of terms

By downloading, installing, or using the ChaChing app, you agree to these Terms of Service ("Terms"). If you do not agree with any part of these Terms, do not use the app.

These Terms constitute a legally binding agreement between you ("User") and Antônio João Damião Filho ("Developer", "we"), developer and owner of ChaChing.

Continued use of the app after changes to these Terms constitutes acceptance of the updated versions. We recommend reviewing this document periodically.

To use ChaChing, you declare that you:

• Are at least 13 years old (or the minimum age required in your jurisdiction).
• Have legal capacity to enter into this agreement.
• Have not been prohibited from using the app by any legal or judicial determination.

Description of service

ChaChing is a personal finance management app that allows users to:

• Create "pockets" — spending categories with personalized limits.
• Record and track financial transactions (expenses and income).
• View monthly and annual spending reports.
• Manage credit cards, bank accounts, and payment methods.
• Control installment purchases and personal investments.
• Sync data across devices (Pro feature).

We reserve the right to change the features available in each plan with reasonable prior notice to users.

ChaChing Pro subscription

4.1 Billing and renewal

The ChaChing Pro subscription is billed monthly (or annually, if available) and processed exclusively by the Apple App Store. Billing occurs at the time of purchase confirmation and automatically renews for the next period unless cancelled at least 24 hours before the end of the current period.

4.2 Free trial period

When available, the free trial begins at the time of confirmation and automatically converts to a paid subscription at the end of the period, unless cancelled beforehand. Only one free trial is permitted per Apple ID account.

4.3 Management and cancellation

You can manage and cancel your subscription at any time through:

• iPhone Settings → Apple ID → Subscriptions → ChaChing Pro
• App Store → Profile → Subscriptions → ChaChing Pro

Cancellation takes effect at the end of the current billing period. There is no prorated refund for unused time after cancellation.

4.4 Refunds

Refund requests are managed by Apple, in accordance with the App Store refund policy. To request a refund, visit reportaproblem.apple.com.

4.5 Price changes

We may change the subscription price. You will be notified in advance and the change will take effect on the next renewal period. If you disagree with the new price, cancel before the renewal.

User account

Account creation is optional for the free plan and required for cloud sync with ChaChing Pro.

5.1 User responsibilities

By creating an account, you are responsible for:

• Maintaining the confidentiality of your password and access credentials.
• All activities conducted on your account.
• Notifying us immediately of any unauthorized use of your account at ajdamiaof@gmail.com.
• Keeping your contact information up to date.

5.2 Account security

Use a strong, unique password. Do not share your credentials with third parties. We are not liable for losses resulting from unauthorized access to your account caused by negligence in safeguarding credentials.

5.3 Account deletion

You can request deletion of your account and all associated data at any time by visiting our account deletion page or emailing ajdamiaof@gmail.com. Deletion is processed within 30 days and is irreversible.

Acceptable use

ChaChing is licensed for personal, non-commercial use. You may:

• Use the app to manage your personal and/or family finances.
• Enter personal financial data honestly and accurately.
• Export your own data for personal use.
• Share your experiences and reviews of the app.

Use of the app for commercial purposes (such as managing third-party finances for compensation) requires prior written authorization.

Prohibited uses

It is expressly prohibited to:

• Use the app for illegal, fraudulent, or third-party rights-infringing activities.
• Attempt to reverse engineer, decompile, disassemble, or extract the app's source code.
• Modify, adapt, translate, or create derivative works of the app without authorization.
• Use automated tools (bots, scrapers) to access or extract data from the app.
• Interfere with the normal operation of the app or its servers.
• Resell, sublicense, or transfer access to the app to third parties.
• Enter false or misleading data that may compromise system integrity.
• Use the app for money laundering, tax evasion, or any unlawful financial activity.
• Attempt to access other users' accounts or data without authorization.
• Post or transmit viruses, malware, or malicious code through the app.

Intellectual property

ChaChing and all its components — including but not limited to source code, design, interface, icons, logos, text, animations, sounds, and features — are the exclusive property of Antônio João Damião Filho and are protected by Brazilian and international intellectual property laws.

8.1 License to use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use ChaChing on iOS devices you own or control, exclusively for personal purposes and in accordance with these Terms. This license does not include the right to:

• Copy, modify, or distribute the app.
• Use the app to create competing products or services.
• Use the name "ChaChing" or any associated brand without authorization.

8.2 Your data

The financial data you enter in the app is your property. By using cloud sync, you grant us a limited license to store and process that data exclusively to provide the sync service. We do not claim ownership of your personal data.

8.3 Feedback

By submitting suggestions, ideas, or feedback about ChaChing, you grant the Developer the right to use that information without compensation, to improve the product.

Disclaimer of warranties

ChaChing is provided "as is" and "as available", without warranties of any kind, express or implied.

We do not guarantee that:

• The app will operate uninterrupted, securely, or error-free.
• Results obtained from using the app will be accurate, complete, or reliable.
• Errors or defects in the app will be corrected.
• The app will be available at all times or on all devices.

ChaChing is not responsible for the accuracy of data entered by users or for consequences of decisions based on incorrect or incomplete data entered in the app.

Limitation of liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, revenue, business opportunities, or goodwill.
• Damages arising from financial decisions based on app data.
• Losses caused by technical failures, interruptions, or service unavailability.
• Unauthorized access to your account or data by third parties, except when caused by our gross negligence or willful misconduct.
• Content of third-party websites or services linked from the app.

Where limitation of liability is not permitted by law, the Developer's total liability shall be limited to the amount paid by the user in the 12 months prior to the event giving rise to the claim or, in the absence of payments, to $10.00 (ten US dollars).

Availability and modifications

11.1 Availability

We strive to keep ChaChing available 24/7, but we do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance whenever possible. We may temporarily suspend the service for technical, security, or operational reasons.

11.2 App modifications

We reserve the right to modify, add, remove, or discontinue ChaChing features at any time. Significant changes affecting paid features will be communicated with reasonable advance notice. In the event of ChaChing Pro discontinuation, the remaining paid period will be honored or refunded.

11.3 Modifications to these Terms

We may revise these Terms periodically. The updated version will be published on this page with a new update date. For material changes, you will be notified via the app. Continued use after notification constitutes acceptance of the new terms.

Termination

12.1 Termination by user

You may stop using ChaChing at any time. For Pro users, termination occurs by cancelling the subscription in the App Store. To delete your account and data, follow the process described in section 5.3.

12.2 Termination by Developer

We may suspend or terminate your access to ChaChing, with or without notice, if you:

• Violate any provision of these Terms.
• Use the app illegally or fraudulently.
• Pose a security risk to other users or the system.

12.3 Effects of termination

Upon termination, your license to use the app is revoked. Local data remains on your device until you uninstall the app or delete it manually. Cloud data is retained for 90 days and then permanently deleted. Provisions that by their nature should survive termination (such as limitation of liability and intellectual property) remain in effect.

Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil, regardless of conflict of law principles.

Any dispute arising from or related to these Terms or the use of ChaChing shall be submitted to the exclusive jurisdiction of the competent courts of São Paulo, SP, Brazil, with express waiver of any other jurisdiction, however privileged.

Before any legal action, the parties agree to attempt to resolve disputes amicably, with prior notice of at least 30 days before filing any claim.

General provisions

Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding ChaChing, superseding any prior agreements.

Severability: if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No waiver: the Developer's failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

Assignment: you may not assign or transfer your rights or obligations under these Terms without prior written consent. The Developer may assign these Terms in connection with a merger, acquisition, or asset sale, with notice to the user.

Communications: formal notices must be sent by email to ajdamiaof@gmail.com. Communications are considered delivered at the time of receipt by the recipient's email server.

Language: these Terms were originally drafted in Portuguese. In the event of translation, the Portuguese version prevails.
